2. Transparency: The information submitted through Form 27 helps the Indian Patent Office (IPO) maintain a record of how patented inventions are being commercially exploited within India. This data contributes to transparency and aids in assessing the impact of patents on the nation’s technological development.

Filing Timelines for Form 27🌱📱

The Patents Amendment Rules, 2024, have introduced significant changes to the filing frequency and timelines for Form 27:

1. Extended Filing Interval: Patent owners are now required to file Form 27 once every three years instead of annually. This reduces the frequency of filing and the associated administrative burden.

2. Exclusion of the Year of Grant: The year in which the patent is granted is excluded from the filing cycle. This provides patentees with adequate time to determine the commercial status of their inventions before filing reports.

3. First Filing Deadlines:

- For patents granted before March 15, 2024, the first Form 27 must be filed by September 30, 2026.

- For patents granted on or after March 15, 2024, the first Form 27 must be filed by September 30, 2027.

4. Deadline Calculation:

- The filing deadline is six months from the expiry of every three financial years, typically falling around September 30th.

- For example, if a patent was granted in the financial year 2022-23, the first Form 27 filing deadline would be September 30, 2026.

5. Extension of Timeline:

- The timeline for filing Form 27 can be extended by three months by filing Form 4 under Rule 131(2) along with the prescribed official fee.

- Further extension by six months can be requested under Rule 138, subject to additional fees.

Penalties for Non-Compliance

Failure to comply with the Form 27 filing requirements can result in significant penalties. According to Section 122 of the Patents Act, non-compliance or providing false information can lead to a fine of up to ten lakh rupees, imprisonment for up to six months, or both.

- Multiple Patents: A single Form 27 can be filed for multiple granted patents if they are related and granted to the same patentee.
